Under Section 13 and Section 14 of the Societies Registration Act, 1860, as applicable to the concerned state of India, a Resident Welfare Association can be dissolved.

A Resident Welfare Association can be sued in the name of either the president or general secretary. This is as per the set rules of a concerned state.

The vacancies in a Resident Welfare Association can be filled by reaching a resolution passed by the maximum number of votes by both the general body and the governing body in an upcoming election.

The financial year for a Resident Welfare Association starts from 1st April and ends on 31st March.

The positions like President, Vice-President, Treasurer, Secretary, etc., are filled by a meeting of the general body of RWA. The residents can specifically raise their hand during the meeting for electing a person. The final list of office bearers is not less than seven. They must be attested by three outgoing bearers and, after that, filed with the registrar of societies.

A Resident Welfare Association’s funds are being operated by the president, treasurer, or the general secretary of the concerned RWA. The funds are being retained in a scheduled bank account.

A Resident Welfare Association’s president is responsible for presiding over the meeting of the governing body and general body, supervising the works of all the office bearers of the concerned RWA, and operating the society’s bank accounts.

A General Secretary of a Resident Welfare Association is responsible for representing the body in a private or public office, maintaining the records of the concerned society, and operating the society’s bank accounts.

Yes, a member of the RWA can be removed from the position if he is not working with a common objective of the RWA. Also, a member can be terminated if a member has not attended three meetings.
